Our responsibility for loss or damage suffered by you.
Whether you are a consumer or a business user :
0. • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
0. • Different limitations and exclusions of liability may apply to your use of the Wippit Print software and/or your purchase of any 3D-Printable Files, which will be set out in our EULA and Purchase Terms.
If you are a consumer:
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time a contract was formed between us pursuant to these terms, both we and you knew it might happen.
When we are liable for damage to your property. If we fail to exercise reasonable care and skill and defective digital content that we have supplied damages a device or digital content belonging to you, we will (at our option) either repair the damage or pay you appropriate compensation in accordance with applicable consumer law.
We are not liable for business losses. Our site is for domestic and private use. If you use our site for any commercial, business or resale purpose we will have no liability to you as set out in the section “If you are a business user” below.
Exclusion. Other than any consumer law right to which you are entitled, all conditions, warranties and other terms not set out in these terms are excluded. You acknowledge that the site has not been developed to meet your individual requirements.

Exclusion. As noted above, we make our site available for personal purposes only. If you are using our site in breach of this restriction, then subject to the section above titled “ If you are a business or consumer user ”, we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, whether direct, indirect, consequential, special or otherwise arising under or in connection with these terms, including use of, or inability to use, our site. Without limitation to the foregoing, we will not be liable for loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation. We exclude all implied conditions, warranties, representations or other terms that may apply to our site.
Uploading content to our site.
Whenever you make use of a feature that allows you to upload content to our site (including, for example, any 3D printable files which you might make available on the Wippit Marketplace), or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy below [https://www.wippit.xyz/policies/terms].
Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you grant us and other users of our site a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to use, store and copy that content and to distribute and make it available to third parties for any purpose.
We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.
We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.
You are solely responsible for securing and backing up your content.
Acceptable use policy.
You may use our site only for lawful purposes. You must not use our site in any way that breaches any applicable law.
We may from time to time provide interactive services on our site, including, without limitation, chat rooms and bulletin boards ( interactive services ).
Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on our site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.
These content standards apply to any and all material which you contribute to our site (including, for example, any 3D printable files which you might make available on the Wippit Marketplace and any description of such 3D printable files which you provide) (Contribution), and to any interactive services associated with it.
The Content Standards must be complied with in spirit as well as to the letter.
We will determine, in our discretion, whether a Contribution breaches the Content Standards.
A Contribution must: (i) be accurate (where it states facts); (ii) be genuinely held (where it states opinions); and (iii) comply with the law applicable in England and Wales and in any country from which it is posted.
A Contribution must not: (i) be obscene, offensive, hateful or inflammatory; (ii) be threatening, harmful, abusive or incite violence; (iii) harass, upset or embarrass any person; (iv) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; (v) breach any law or legal duty to any person; (vi) promote or incite any party to commit, or assist any unlawful or criminal act; (vii) infringe any right (including any intellectual property right) of any person; (viii) deceive any person; (ix) be defamatory of any person; (x) impersonate any person, or misrepresent your identity or affiliation with any person; (xi) give the impression that the Contribution emanates from Wippit; (xii) contain any advertising or promote any services or web links to other sites.
We are not responsible for viruses and you must not introduce them.
We do not guarantee that our site will be secure or free from bugs or viruses.
You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
You may not use our site to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
You may not access without authority, interfere with, damage or disrupt (i) any part of our site; (ii) any equipment or network on which our site is stored; (iii) any software used in the provision of our site; or (iv) any equipment or network or software owned or used by any third party.
Rules about linking to our site.
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link to our site in any website that is not owned by you.
